Dark pattern

The definition turns on cost rather than on truth, which is why so many arguments about it go nowhere. Almost none of these designs contain a false statement — the total is on the screen, the terms are linked, the decline button exists. What is arranged is the effort: one path takes a click and the other takes six, one option is a filled button and the other is grey text, one number is in the heading and the other is in a clause.

Harry Brignull named the category in 2010 and renamed it to deceptive patterns in 2023; the European Data Protection Board made the same move in the second version of its guidelines. The rename matters for a practical reason rather than a stylistic one. Dark implies intent, and intent is the one thing an outside observer cannot establish and no instrument requires them to.

Data Nexus separates these from persuasion on a single test: whether every number is disclosed in the unit of the decision the buyer is making. A rate is not a unit of decision. A monthly instalment is not a unit of decision. A balance in tokens is not a unit of decision.

Treating it as an ethics question when the exposure is contractual

The usual debate is about whether a pattern is manipulative, which cannot be settled and does not need to be. The consequence arrives from the payment schemes long before a regulator forms a view: disputes are computed monthly whether anyone complains or not, and a transaction the buyer did not intend is a dispute. A business arguing about intent has already lost the argument that decides its acquiring.
